The rule to know here is not the height, it is the setback. Gilroy allows 7 feet, but anything over 3 feet has to sit 26 feet back from the curb. On a shallow front yard that quietly rules out a tall fence anywhere near the street, and it is the single most common thing homeowners here find out after they have already bought the material.
West Gilroy soil holds water through the winter and dries hard in July. That cycle is what pushes posts out of plumb over a few seasons, so we set deeper here than the minimum and we do not hang rails on green concrete.
